If the recording was ever released commercially or is in the public domain or it was acquired with the permission of the copyright owner it doesn't matter.

The only exception would be a clear-cut crime like stealing a CD from a music store.

Ripping from a friend's CD or having a friend rip it for you, or downloading from an unauthorized site are issues that I am unqualified to jugde. If it's out of print, then there is much less to criticize.

Capt. Wayne has pointed out that he would NOT use a live in-studio performance from someone else's radio show without permission.
